Am 20. Januar stürmten 70 Polizisten aus Neuseeland und den USA Kim Schmitz’ protziges Anwesen „Villa Dotcom“ bei Auckland, nahmen den dicken Internet-Millionär in seinem Panic Room fest. Jetzt äußerte sich erstmals Schmitz‘ hochschwangere Ehefrau Mona – sie spricht von Polizei-Terror bei der Verhaftung!

Wie die „NZ Herald“ berichtet, wandte sich Mona Dotcom nach der Festnahme ihres Mannes mit einem Schreiben ans Gericht, bat darin um dessen Freilassung aus der U-Haft.„Wir waren noch niemals länger als einen Tag getrennt“, zitiert die Zeitung aus den Gerichtsunterlagen. „Obwohl ich mein Bestes tue, um damit fertig zu werden, fällt mir ohne Kims Unterstützung Zuhause alles sehr schwer.“

Mona Schmitz ist mit Zwillingen schwanger, die noch in diesem Monat auf die Welt kommen sollen. Das seit 2009 verheiratete Paar hat bereits drei gemeinsame Kinder.

In ihrem Schreiben ans Gericht beschwert sich die bald fünffache Mutter massiv über das Verhalten der Polizei während der Razzia auf ihrem 19-Millionen-Euro-Anwesen.„Obwohl ich ganz offensichtlich schwanger und noch im Nachthemd war, befahlen die Polizisten mir nach draußen zu gehen und auf dem nassen Gras zu warten.“Man habe sie eine Stunde dort warten lassen und mit Waffen bewacht. „‚Sie haben mich einfach nicht gehen lassen. Ich habe mehrmals darum gebeten, reingehen zu dürfen, um nach den Kindern zu sehen. Aber ich durfte nicht.“

Erst weitere 20 bis 30 Minuten später habe man sie zu den Kindern gelassen, die alle „total verängstigt“ gewesen seien. Ermittler ließen nach der Schließung von Kim Schmitz‘ Filmklau-Website „Megaupload“ die Firmenkonten sperren. Beschlagnahmt wurden auch die Kreditkarten seiner Frau – die ebenfalls auf „Megaupload“-Konten liefen.„Ich habe überhaupt kein eigenes Geld mehr oder Zugriff auf andere Quellen“, jammerte Mona Dotcom im Unterstützungsschreiben für ihren Mann. Es sei auch kein Geld da, um die Kindermädchen zu bezahlen, die jetzt kündigen würden. „Es ist sehr schwierig, sich um drei kleine Kinder unter vier Jahren zu kümmern und mit zwei weiteren schwanger zu sein“, schreibt Mona weiter.

Und sie drückt noch ein bisschen weiter auf die Tränendrüse: Ihr Mann würde seine Kinder sehr lieben und vermissen.Er sei nicht der Mann, als den die Medien ihn darstellten. „Er ist ein totaler Familienmensch. Die Kinder und ich stehen für ihn immer an erster Stelle.“Ob das herzzerreißende Schreiben ausschlaggebend war oder doch andere Gründe – die neuseeländischen Richter ließen letztlich Gnade walten. Ende Februar wurde Kim Schmitz gegen Kaution aus der U-Haft entlassen.

How Dotcom won fight for number plates – NZ Herald News

The origin of the exotic cars and number plates belonging to internet mogul Kim Dotcom lies in the crumbling fortunes of a multi-millionaire property developer.

The public watched astonished as one luxury car after another was taken from Dotcom’s $30 million North Auckland mansion after a police raid.

For David Blackmore, it was an echo of the day he watched his own fleet of luxury cars being seized after defaulting on a $1.25 million loan to Dotcom.

As well as the cars, Blackmore lost the distinctive GUILTY, MAFIA, POLICE, STONED, GOOD and EVIL number plates, which had led to so much speculation about the oddity of Dotcom.

Car-crazy, tattooed and obsessed with the number 666, Blackmore previously owned the plates and some of the cars which were then seized from Dotcom at the order of the United States Department of Justice.

Among them was the Lamborghini LM002, the „Rambo Lambo“ which Blackmore and pornographer Steve Crow took to the infamous Gumball Rally in 2006 in an eight-day, $200,000 odyssey of fast cars and friendship.

It was the Gumball Rally over which Blackmore and Dotcom bonded in Hong Kong when they met at the $12,000-a-day Grand Hyatt suites rented by the internet tycoon.

As Dotcom said: „There is a bond with a fellow Gumballer“.

Blackmore borrowed $1.25 million and put cars and the unusual set of number plates up as security for the debt.

The relationship started amicably but ended in a crossfire of legal letters.

For Blackmore, the money came at a time when his property portfolio was collapsing.

„I thought this wasn’t a bad sort of an option. I thought this gives me some breathing space.“

At one time, he owned properties worth about $50 million through a string of companies. Now, many of those companies are in liquidation. Reports filed with the Companies Office estimate debts of about $24 million.

In that, his story mirrored other former giants of the property market.

„The money dried up,“ he said. Property worth $10 million was suddenly worth half that. He had two mortgages on property and said one lender insisted on a third mortgage to restrict his ability to borrow more money.

So, when Dotcom emerged with a loan offer, he took it. „I probably wouldn’t have got it with the likes of Marac and GE. People have a funny idea that money lenders are there to lend money. They are not. They are there to make money.“

The loan from Dotcom allowed him to consolidate all his vehicle debts in one place. The cars were then to be sold to repay the debt to Dotcom, he said.

As the market collapse accelerated, Blackmore found himself trapped.

„You can’t just get a lick of paint and another tenant .. you need millions of dollars and it’s not out there.

„Annoying would be an understatement. There’s a certain amount of stress … frustration. You have no control over it.“

Blackmore began selling his cars, with a Rolls-Royce going for $250,000. The money was paid to Dotcom – and led to a dispute.

In Blackmore’s view, the money should have come off the interest.

Not so, said Dotcom’s lawyer in the deal, Simpson Grierson partner Greg Towers. „It was not an interest payment.“

He said the Rolls-Royce was sold after Dotcom released security on the car. He did so on the condition the money went into reducing the size of the loan.

„Months went by with no interest payments,“ said Towers.

„We went through the legal process of serving a default notice.“ Still, no payments were made and the cars and the plates covered by the loan agreement were seized.

The cars were sold through Turners Auctions. Some were bought by Dotcom, although a Rolls-Royce Silver Phantom remains without a buyer.

The plates were sold through Trade Me.

Dotcom won a number of auctions, buying the number plates which became famous on the day of the raid.

Six days later, Blackmore lost his grip on the first of his property companies. Number One Properties Ltd owned three properties in Auckland, including a luxury suite in the swanky Metropolis apartment building. It went into liquidation with the current debt level pegged at $13 million.

Blackmore Trust Ltd followed. The latest receiver’s report at the Companies Office pegged assets at $14 million and debt at $24 million.

The company’s jewel in the crown was the landmark James Smith Building in Wellington’s Cuba St.

It was recently sold and Blackmore now works there, managing the refurbishment.

He expects to be bankrupted.

„Nothing much has changed for me – other than I have I don’t know how many millions in personal guarantees, which will bury me in the end.“

Even her nationality is unclear, although some websites suggest she is a former model from the Philippines.

She and Dotcom have three previous children together – two sons and a daughter – and relocated to New Zealand in 2009.

Evidently adored by Dotcom, Mona is reported to have spent New Years’ Eve watching thousands of dollars’ worth of fireworks paid for by her husband.

A question mark now hovers over Mona’s involvement in Megaupload, with speculation that she is now being investigated for her role in the company.

Dotcom was arrested in February and is awaiting extradition to the United States, where he is facing charges of racketeering, copyright infringement and money laundering in relation to Megaupload.

He is currently on bail and has been granted $32,650 to live off for three weeks, after seeking significantly more at a High Court hearing.

Dotcom and his wife sought $28,000 a month to pay for household expenses and an additional $29,000 for staff and maintenance costs for their $10 million mansion.

Dotcom says he wants to stay in New Zealand and raise his children here.

It became the most online part of the country after internet tycoon Kim Dotcom paid for an ultra-fast broadband cable into the community where he lives.

Now, it is an internet deadzone.

Yesterday, the Herald on Sunday followed the rules for all visitors to the home where Dotcom has been bailed to wait on an extradition hearing.

All cellphones, laptops and smartphones must be left at a perimeter before you’re able to enter the property. Closer, at the family home, all entrances carry the sign: „No smartphones and internet devices.“

The ban on internet access was among bail conditions placed on Dotcom when he was freed on Wednesday. He spent a month in jail after a US-requested arrest on charges of criminal copyright violation.

After six nights at home, Dotcom will return to court this week to face US attempts to have him returned to prison.

Last night, he was enjoying time with wife Mona and their three children – Kimmo, Kaylo and Kobi – at their home in Coatesville. The notice of appeal was frustrating news, Dotcom said. He had hoped receiving bail would give his wife confidence he would be home when she gives birth to twins next month.

When the case goes back to court, the issue is likely to be the same.

The US case for keeping Dotcom in jail has turned on whether he is a flight risk – and whether he has the money to flee.

The January 20 raid on Dotcom and his Megaupload business has frozen hundreds of millions of dollars in funds.

It is uncertain, Kiwi taxpayer-funded lawyer Anne Toohey has said, that all his assets have been seized.

The Herald on Sunday was the only media present for the courtroom argument between Toohey and Dotcom’s lawyer Paul Davison QC.

Judge Nevin Dawson told Toohey that Dotcom was being asked to „prove a negative“ which seemed „unfair“. „If there is no evidence, surely there is no proof and surely the benefit of the doubt must be exercised in favour of Mr Dotcom.“

In the hearing, Dotcom said there was no money remaining which had not been seized and he could not even afford to pay legal fees to fight the case.

„I am absolutely no flight risk. I have no reason to be a fugitive with a wife, three kids and two more little kids coming in a few weeks … I have absolutely no reason to run away.

„The FBI have seized all my assets. They have traced every financial transaction since 2010. There is absolutely nothing that hasn’t been found.“

EIN INTERNET-PIRAT ALS NACHBAR?

Die US-Behörden werfen Schmitz vor, allein im Jahr 2010 durch seine mutmaßlich illegalen Internetaktivitäten 42 Millionen Dollar rund 32 Millionen Euro verdient zu haben.„Megaupload“ bot seinen Nutzern an, Daten im Internet zu speichern und dort auch anderen zur Verfügung zu stellen. Dies ist an sich nicht verboten. Allerdings wurde die Plattform auch dazu genutzt, Raubkopien etwa von Musik, Filmen und Software zu verbreiten.Die Entscheidung des Richters das Dotcom-Schwergewicht auf Kaution freizulassen, gilt als ein Rückschlag für die US-Justiz, die eine Auslieferung der vier „Megaupload“-Verantwortlichen fordert.Eine Anhörung zu den Auslieferungsanträgen soll voraussichtlich am 20. August stattfinden. Sollte der aus Kiel stammende Schmitz vor ein US-Gericht gestellt werden, droht dem ehemaligen Internet-Hacker die Maximalstrafe von 20 Jahren Haft.
